This Legal Notice sets out the terms that govern every purchase from Mystic Moon Emporium ("the Store," "we," "us," "our"). By buying anything from us, you agree to all of it. If you don't agree, don't buy.
1. WHO WE ARE
Mystic Moon Emporium is an online retail store based in the State of Texas, United States. Contact: mysticmoonemporium.store@gmail.com. We respond to emails within 24 hours. We do not take phone calls.
2. AGREEMENT TO THESE TERMS
Placing an order means you have read, understood, and accepted this Legal Notice in full. These terms apply to every product, every order, no exceptions.
3. PRODUCTS AND DESCRIPTIONS
We describe our products as accurately as we can, including photos and details from our suppliers. But we don't guarantee that colors, sizes, or appearances will match your screen exactly, and we don't promise any specific result from using a product. What you see is what we've got — no more, no less.
4. PRICING
Prices are listed in US dollars and can change at any time without notice. The price you pay is the price shown at checkout when you order.
5. PAYMENT
We accept the payment methods shown at checkout. Your order is not confirmed until your payment clears. If payment fails or is reversed, we cancel the order.
6. SHIPPING
Your order ships AFTER your payment has fully cleared and the funds are in our account. Until the money hits our balance, nothing ships — no exceptions.
Delivery time estimates are estimates only, not promises. Delays happen — weather, carriers, suppliers — and they're out of our hands. We're not liable for late delivery.
Make sure your shipping address is correct. We're not responsible for packages lost or delayed because you typed your address wrong.
Tracking numbers are provided when available.
7. RETURNS AND REFUNDS
Print-on-demand t-shirts are made to order, just for you. ALL SALES ARE FINAL. No refunds, no returns, no exchanges. Measure yourself and pick the right size before you order — if you're unsure, look up the shirt sizing online first.
Returns are accepted on all other products, provided the item is unused and in its original condition.
If a product arrives damaged or wrong, contact us by email within 7 days of delivery so we can make it right.
8. PRODUCTS SOLD AS-IS / NO WARRANTY
Every product is sold AS-IS, with no warranties of any kind — express or implied. We don't warrant that any product is fit for a particular purpose, free of defects, or exactly as pictured. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
9. ASSUMPTION OF RISK
You buy and use our products entirely at your own risk. If a product involves small parts, sharp edges, wearables, cosmetics, or anything you put on or in your body, it's YOUR job to use it safely and check that it's right for you. We're not responsible for how you use what you buy.
10. NO LIABILITY FOR INJURY OR HARM
Mystic Moon Emporium, its owner, and its suppliers are NOT liable for any injury, illness, allergic reaction, harm, damage, or loss arising from any product — whether you used it right, used it wrong, or just looked at it funny. If you get hurt, that's not on us. Period.
11. LIMITATION OF LIABILITY
To the maximum extent permitted by Texas and United States law, our total liability for ANY claim — injury, damage, dissatisfaction, whatever — will never exceed the amount you paid for the product in question. We are never liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits. Ever.
12. INDEMNIFICATION — YOU COVER US
By buying from us, you agree to hold harmless and indemnify Mystic Moon Emporium, its owner, and its suppliers against any claim, demand, cost, or expense (including legal fees) arising from your purchase, your use or misuse of a product, or your violation of these terms. You break it, you bought it — and you cover us too.
13. NO LAWSUITS / DISPUTE TERMS
By purchasing from us, you agree not to bring any lawsuit against Mystic Moon Emporium, its owner, or its suppliers over any product or transaction, to the fullest extent the law allows. If a dispute arises that can't be resolved by email, it will be handled under the laws of the State of Texas, in Texas courts. You waive any right to participate in a class action against us.
14. AGE REQUIREMENT
You must be 18 or older to buy from us, or have a parent or guardian's permission. We're not responsible for purchases made by minors behind their parents' backs.
15. PROHIBITED CONDUCT
Don't use our store for fraud, chargeback abuse, or harassment. We reserve the right to cancel orders and refuse service to anyone who does.
16. INTELLECTUAL PROPERTY
Our store name, branding, designs, and content are ours. Don't copy, reproduce, or resell them without written permission.
17. CHANGES TO THESE TERMS
We can update this Legal Notice at any time. The version in effect when you placed your order applies to that order.
18. SEVERABILITY
If any part of this notice is found unenforceable by a court, the rest still stands, and the unenforceable part will be read as narrowly as possible.
19. GOVERNING LAW
This Legal Notice is governed solely by the laws of the State of Texas and applicable United States federal law — to the maximum extent the law allows. The laws of any other state, including California, do not apply to your purchase or to these terms.
